Notary Public

A notary public is a public officer who is authorized by the government to perform certain legal functions, primarily related to the authentication and certification of documents and transactions. The primary role of a notary public is to act as an impartial witness to the signing of important documents and to verify the identity of the parties involved.  The purpose of notarization is to add credibility and authenticity to legal documents.

Notaries are expected to follow specific guidelines and regulations.  Some common responsibilities of a notary public include:

1. Verifying the identity of individuals: Notaries are responsible for confirming the identity of the signatories by checking their identification documents, such as passports or driver's licenses.

2. Witnessing document signings: Notaries observe the signing of documents to ensure that all parties are willingly and knowingly entering into the agreement.

3. Administering oaths and affirmations: Notaries have the authority to administer oaths or affirmations, which are legally binding statements made by individuals regarding the truthfulness and accuracy of the information provided in a document.

4. Certifying document copies: Notaries can make certified copies of certain documents, attesting that they are true replicas of the original.

Apostille - County Clerk Certification

An apostille is a certificate issued by a designated authority in a country that is a party to the Apostille Convention.  The purpose of an apostille is to authenticate the origin of a public document, such as a birth certificate, marriage certificate, court judgement, or notarized document, so that it can be recognized and accepted in another country that is also a party to the convention.

The apostille certifies the authenticity of the signature, the capacity in which the person signing the document acted, and the seal or stamp affixed to the document.  It simplifies the process of document authentication by eliminating the need for additional certifications or legalization.

Divorces

In Florida, divorce also referred to as "dissolution of marriage." Here are some key points to know about the divorce process in Florida:

1. Residency Requirements: To file for divorce in Florida, either spouse must be a resident of the state for at least six months prior to filing.

2. Neither spouse needs to prove fault or wrongdoing to obtain a divorce in Florida. It is enough to state that the marriage is irretrievably broken.

3. Filing Process: The divorce process begins by filing a Petition for Dissolution of Marriage with the circuit court in the county where either spouse resides. The petition outlines the desired terms for the divorce, such as child custody, child support, property division, alimony, as well as division of marital assets and debts.

4. Parenting Plan and Parenting Class: If the couple has children both parents will have to attend a Parenting Course approved by the court.  Time-sharing will also be addressed, visitation, and child support.

5. Simplified Dissolution: In cases where the spouses agree on all issues and meet specific criteria, they may qualify for a simplified dissolution of marriage, which is a quicker process.

6. Waiting Period until Final Judgement:  It usually takes six weeks to finalize a divorce from the time the divorce petition is filed until a final judgment of dissolution of marriage is issued.
